Prison Time for Five Time DWI Defendant

A man who has been arrested at least five times for DWI has been sentenced to four months in jail after accepting a deal from prosecutors.  A story published in The St. Louis Post-Dispatch reveals that the driver, who crashed into two parked cars at a McDonalds in Des Peres Missouri in 2010, was unaware he had hit any vehicles.   Three hours after the accident his blood test showed a .39 blood alcohol level. An earlier test showed a .426 BAC – more than five times the legal limit.

This would have been the man’s second felony conviction for DWI which usually carries a five year jail term. A plea bargain was struck whereby if he pled guilty and went through a drug-alcohol program while in jail the longer sentence would be avoided. Too many times this kind of story leads to more than just damaged vehicles – in many cases there are injuries and wrongful deaths caused by chronic DWI offenders.
