Missouri Court Ruling Increases Birth Injury Malpractice Settlements by Insurance Companies

Birth injury cases may not happen all the time near St. Louis, but they happen often enough that a Missouri State appelate court saw fit to increase payouts from insurance companies. The court ruled that because there were two human lives that were impacted as a result of negligence, the doctor was liable for them both. 

A Closer Look at This Birth Injury Case

The case that led to the court's ruling involved a pregnant mother who was under the care of a physician. She began having complications and was admitted to the hospital for four days. She was discharged without improving, and her condition continued to decline over the next several days. She continued to be in contact with the doctor, but he seemed to ignore her requests for help. 

Finally, the woman returned to the doctor's office, and staff was not able to get a blood pressure for her. Her baby's heart rate was quickly declining and was not moving. The doctor elected to perform an emergency cesarean section in his office, without the standard equipment to do so safely. 

The result was that both the mother and the baby suffered from injuries that will plague them for the rest of their lives.
